New Swedish Law Says Sex Without Explicit Consent Is Rape

This week Sweden adopted a new law that requires explicit consent prior to sexual activity or the act would be considered rape. Lawmakers approved the measure 257-38 with 54 absentees; the law will go into effect across the country on July 1st. 

According to the new law: “It is no longer necessary for the offender to use violence or threats, or to exploit the victim’s particularly vulnerable situation... If a person wants to engage in sexual activities with someone who remains inactive or gives ambiguous signals, he or she will therefore have to find out if the other person is willing”. 

Two new crimes – negligent rape and negligent sexual abuse - are also included in the law. Each crime carries a four-year prison sentence. Still, critics say the law won't produce any new rape convictions.
